Renting in Dubai: How to get your security deposit back and what to do if your landlord refuses

For many people renting a home in Dubai, the security deposit represents a significant amount of money. Tenants typically pay this deposit before moving into a property, and it is expected to be returned when the lease ends. However, when tenants move out, some discover that getting their deposit back is not always as straightforward as they expected.

Understanding how rental deposits work in Dubai can help tenants avoid unnecessary stress and protect their rights when their lease comes to an end. By knowing what the law says and keeping proper documentation throughout the tenancy period, renters can greatly improve their chances of receiving their full deposit without complications.

A rental security deposit is a standard requirement for most residential leases in Dubai. Landlords request this payment at the beginning of the tenancy as a financial safeguard against potential damage to the property or unpaid service bills. The deposit acts as a form of protection for property owners while also creating an obligation for tenants to maintain the property responsibly.

In general practice across the city, the deposit amount depends on whether the property is furnished or unfurnished. For unfurnished apartments or villas, the deposit is usually around five percent of the annual rent. For furnished properties, the amount often increases to approximately ten percent of the yearly rent. The exact figure may vary based on the terms agreed upon in the tenancy contract, so tenants should always review the lease carefully before signing.

When a tenant moves out, the deposit should be returned in full as long as the property is handed back in acceptable condition and all bills have been settled. Normal wear and tear is typically not considered damage. However, disputes sometimes arise when landlords believe the property requires repairs, additional cleaning, or when there are unpaid utility charges.

Because of this, tenants are encouraged to take preventive steps from the beginning of their tenancy. Conducting a detailed inspection before moving in can help establish the condition of the property at the start of the lease. Taking photos or videos of rooms, appliances, walls, and floors provides clear documentation of any existing marks or damage. Sharing this evidence with the landlord can help prevent disagreements later.

During the tenancy, it is also wise to keep records of any maintenance requests or communications with the landlord or building management. Written confirmation of repairs, approvals, or issues can serve as valuable proof if questions arise when the lease ends.

As the move-out date approaches, tenants should follow the procedures stated in the contract. This usually includes providing the required notice period, removing all personal belongings, and arranging a thorough cleaning of the property. It is also important to settle all outstanding payments such as electricity, water, internet, and phone services before vacating the unit.

Taking final photos or videos of the property after cleaning and minor repairs can provide a clear record of the apartment’s condition at the time it was returned. This documentation can be very useful if a landlord later claims damages that the tenant believes are incorrect.

While many landlords return deposits without issue, problems can sometimes occur. In some cases, tenants may experience delays or receive no response after requesting the return of their deposit. The first step in such situations is usually to communicate with the landlord in writing, clearly referencing the tenancy agreement and requesting the refund.

If attempts to resolve the issue privately do not succeed, Dubai provides a formal process for tenants to seek assistance. The city has established a specialized legal body to handle rental disagreements and enforce tenancy regulations when disputes arise between tenants and property owners.

Tenants who are unable to recover their deposit may submit a claim through the Rental Dispute Centre. One available legal option is known as a Writ of Payment, which is a request asking authorities to enforce the payment of money that is legally owed.

To file this request, tenants typically need to prepare several supporting documents. These may include the registered tenancy contract, written proof showing the amount owed, documentation confirming that the landlord was formally notified of the payment request, and identification documents such as an Emirates ID. In some cases, additional supporting materials such as communication records, bills, or other related documents may also be required.

The application can be submitted through the Rental Dispute Centre’s online platform or through authorized service centers. After submitting the required documents and paying the relevant service fees, the case is reviewed by a judge. If the ruling supports the tenant’s claim, instructions are issued for recovering the deposit through the appropriate legal channels.

Service fees generally include a percentage of the claimed amount, along with several smaller administrative charges. While the exact total depends on the amount involved, the process provides tenants with a clear legal pathway to recover funds that are rightfully theirs.

For anyone renting property in Dubai, awareness of these procedures can make a major difference. By keeping proper records, maintaining open communication with landlords, and understanding the legal options available, tenants can protect themselves and ensure that their rental deposits are handled fairly when their tenancy comes to an end.
